Landlords in most states must give the tenant three or five days to pay the rent or face a termination. This notice is easy to fill out and can be downloaded from this web site.
If you have a lessee who pays the rent late, most states allow you to immediately send a termination notice to the individual. This form gives the renter three days in which to bring the rent up-to-date or move out ("quit"). If the tenant doesn't respond to the notice and doesn't move, you can file for eviction.
Most states allow lessors to send a pay rent or quit notice on the first day the rent is late; a few don't allow you to send it until the renter is a certain number of days late. Find out the time frame that applies to you and serve the notice as soon as possible. The more past-due the rent, the more money you lose.
In many states, if the tenant pays the rent late a second or third time within a specified number of months, the property owner doesn't have to allow the usual few days to pay. If paying the rent on time is a recurring problem for your lessee, you may be able to end the tenancy immediately the next time the rent is late.
