POWER OF ATTORNEY - REVOCATION

You granted your spouse a General Power of Attorney to act on your behalf...and now you have separated.

You no longer want him or her to have access to your bank accounts, and you sure don't want any loans taken out with your name on them. What to do?

Download a Revocation of Power of Attorney, which is free from this site, and fill it out. Then take it to a notary, sign it, and have it recorded.

There are other reasons why you might change your mind about someone else having your Power of Attorney, but dissolution of marriage or partnership is a common one. Another reason might be that you gave a child power of attorney and now that child has married. You might feel that the new spouse has undue influence and might persuade your child to do something not in your best interests.

Happier reasons might be that you only intended to grant a short term Power of Attorney while you traveled … or because you were ill or undergoing surgery and were worried about the outcome. Now you are back and fully capable of handling your own affairs.

Whatever your reason, it is your right to execute a Revocation of Power of Attorney. No one else needs to agree or to sign. The only requirement is that you sign in front of a notary. Then, in order to fully protect your interests, you must have the document recorded.

Be sure when you fill out the Revocation to name the party exactly the same way you named them in the document granting them power. If you used their middle name or initial, use it again. If you named them with a designation such as Jr. or Sr. be sure to include that as well. You want to clearly remove the same person that you designated.

In the event that you still want someone to have the power to sign for you, you can now execute a new Power of Attorney...either General or Limited...naming the new person.
