RENTAL AGREEMENT - LEASE AGREEMENT

The terms rental, lease or tenancy pertaining to real estate is the right to use and/or occupy real property provided by a lessor ( landlord, owner, corporation ) to another person or entity (usually called the lessee or tenant) for a fixed or indefinite period of time. The lessee or tenant obtains exclusive possession of the property in return for paying the lessor a fixed or determinable consideration (lease or rental payment). The amount of rental, address of the property and any other stipulations agreed upon by the two parties are compiled and entered into a document called the "Rental Agreement."

A real estate type of RENTAL AGREEMENT can be either residential or commercial.

RESIDENTIAL RENTAL AGREEMENT: pertains to homes, condos and apartments.

COMMERCIAL RENTAL AGREEMENT: pertains to stores, offices and industrial buildings.

There are two common types of rental agreements: a lease and a month-to-month tenancy agreement.

MONTH-TO-MONTH TENANCY:

The month-to-month tenancy agreement may be made orally or in writing. However, if fees or refundable deposits are involved, save yourself a lot of anguish by executing a written document.
The month-to-month may be for an indefinite period of time, with rental usually payable on a monthly basis.

Rental/Lease Agreement Basics:

The Rental/Lease Agreement restricts both parties from changing any of the terms during the entire rental period and must be in writing to be legal enforceable. It is a common practice for a rental period to be 1 year or more.

Keep in mind that there really is no formal absolute rental/lease agreement type of document. Any stipulation, rules or terms that both parties agree upon is valid and may be included within the agreement as long as these terms are lawful and the intent is to form a legally binding relationship.

The results of Negotiations between the lessor ( landlord,owner ) and the potential tenant usually determines the final agreement. However, all Rental/Lease Agreements must contain certain basic elements.

The rental commencement date must be stated. The rental expiration date must be stated. The names of all parties involved must be stated. The rental/lease amount is usually stated in terms of the monthly rental payable at a certain time period and at a certain place. The property address, and complete detail of all deposits must be stated. Confirmation of all stipulations must be acknowledged by both parties signing the agreement.
